### Conditions for Upgrading Provincial Development Zones to National Development Zones in 2011

#### (1) General Principles

1. The development zone must have a clearly defined scope, and after the cleanup and consolidation review, it must meet the overall requirements of "concentrated layout, industrial agglomeration, and intensive land use."

2. It must comply with the principles of "primarily focusing on improving the quality of foreign investment, primarily focusing on developing modern manufacturing, primarily focusing on optimizing the export structure, dedicated to developing high-tech industries, dedicated to developing high-value-added industries, and promoting the transformation of development zones into multi-functional comprehensive industrial parks."

3. It must have a first-level fiscal system and implement a management and operation mechanism that is centralized, streamlined, flexible, efficient, business-friendly, and pragmatic.

#### (2) Comprehensive Development Status

1. Referring to the comprehensive evaluation method for the investment environment of national development zones, the comprehensive economic strength of the provincial development zone applying for upgrading must reach the medium or higher development level of national development zones in the province during the same period.

2. The main economic indicators of the provincial development zone applying for upgrading must rank in the top five among provincial development zones in the province in the previous year.

3. The development zone applying for upgrading must meet the following development foundations:

1. Annual industrial output value of more than 1.5 billion yuan per square kilometer;

2. Annual tax revenue of more than 500 million yuan;

3. Annual export value of more than 250 million US dollars;

4. Cumulative actual foreign direct investment of more than 500 million US dollars.

#### (3) Documents and Supporting Materials to be Submitted

1. A comprehensive report on the social and economic development of the development zone (including basic information, economic development status, industrial characteristics, intensive land use, environmental protection, energy conservation, emission reduction, and social responsibility).

2. Approval documents from the provincial government for the establishment of the development zone, as well as approval documents and explanations for the management system, organizational structure, main responsibilities, personnel编制, and fiscal system.

3. Urban planning of the development zone, including the proportion of industrial, warehousing, real estate, and other types of land use, approved documents, texts, descriptions, and drawings, jointly issued by the development zone management committee or the urban planning management department of the city, with a proof document from the provincial urban planning management department attached.

4. Proof documents for the cleanup and consolidation review and announcement of the development zone.

5. Proof documents from the provincial commerce department regarding the comprehensive strength ranking of the development zone in the province and the main economic indicators of the previous year.

6. Land use review report and technical evaluation report on intensive land use issued by the land and resources department of the province.

7. Report on the implementation of environmental protection in the development zone issued by the provincial environmental protection department.

### Application Procedure

1. The municipal government submits an application to the provincial government.

2. The provincial government forwards the application to the provincial commerce department, which will review it in conjunction with the housing and urban-rural development department and the land and resources department, and provide an opinion on whether to submit it to the State Council.

3. The provincial government submits the application to the State Council, which will forward it to the Ministry of Commerce, the Ministry of Housing and Urban-Rural Development, and the Ministry of Land and Resources for review, and seek the opinions of the National Development and Reform Commission and the Ministry of Environmental Protection, and provide an opinion on whether to agree to the establishment of a national development zone to the State Council.

4. The State Council issues a document.
